1. Agreement to Terms

By accessing or using the Everyday Love website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Description of Service

Everyday Love provides an online platform for creating personalized photo books with embedded QR codes that link to voice recordings. Our services include:

Photo book design and creation tools
Voice memo recording and storage
QR code generation for audio playback
Professional printing and shipping of physical photo books
Collaborative features allowing multiple contributors

3. Account Registration

To use certain features of our Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

You must be at least 18 years old or have parental/guardian consent to use our Service.

4. User Content and Intellectual Property

4.1 Your Content

You retain all ownership rights to the photographs, voice recordings, and other content ("User Content") you upload to our Service. By uploading User Content, you grant us a limited, non-exclusive license to use, store, reproduce, and process your content solely for the purpose of providing our Service.

4.2 Content Warranties

By uploading User Content, you represent and warrant that:

You own or have the necessary rights to use all content you upload
You have obtained consent from any individuals depicted in photographs or recorded in voice memos
Your content does not infringe on any third party's intellectual property rights
Your content does not violate any applicable laws or regulations

4.3 Prohibited Content

You may not upload content that:

Is illegal, harmful, threatening, abusive, or harassing
Contains nudity, pornography, or sexually explicit material
Promotes violence, discrimination, or hatred
Infringes on copyrights, trademarks, or other intellectual property
Contains viruses, malware, or other harmful code
Violates the privacy rights of others

We reserve the right to remove any content that violates these Terms and to terminate accounts of repeat offenders.

5. Orders and Payment

5.1 Pricing

All prices are displayed in US dollars and are subject to change without notice. Prices shown at the time of your order will be honored. Shipping costs are calculated at checkout based on your location and selected shipping method.

5.2 Payment Processing

Payments are processed securely through Stripe. By placing an order, you authorize us to charge your payment method for the total amount of your order, including applicable taxes and shipping fees.

5.3 Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or decline your order at our discretion. An order is accepted when we send you an order confirmation email and begin production.

6. Production and Shipping

6.1 Production Time

Photo books are custom-made products. Production typically takes 5-7 business days after order confirmation. Production times may vary during peak periods or due to unforeseen circumstances.

6.2 Shipping

Shipping times are estimates and may vary. We are not responsible for delays caused by shipping carriers, customs processing, or circumstances beyond our control. Risk of loss passes to you upon delivery to the shipping carrier.

6.3 Delivery Issues

You are responsible for providing accurate shipping information. We are not liable for orders delivered to incorrect addresses provided by you. If a package is returned to us due to an incorrect address, you will be charged for reshipment.

7. Returns, Refunds, and Cancellations

7.1 Custom Products

Because our photo books are custom-made with your personal content, we generally cannot accept returns or provide refunds for change of mind or ordering errors. Please review your book carefully before placing your order.

7.2 Defective Products

If your order arrives damaged, defective, or with significant printing errors that are our fault, please contact us within 14 days of delivery with photos of the issue. We will, at our discretion, either reprint and reship the product at no charge or provide a refund.

7.3 Cancellations

Orders may be cancelled within 24 hours of placement if production has not yet begun. Once production starts, orders cannot be cancelled.

7.4 Print Quality Disclaimer

Colors in printed products may vary slightly from what appears on your screen due to differences in monitor calibration and printing processes. Minor variations in color, cropping, or positioning are inherent to the printing process and do not constitute defects.

8. QR Codes and Voice Memo Access

QR codes in your photo book link to voice recordings hosted on our servers. We will maintain access to these recordings for a minimum of 5 years from the date of your order. We will make reasonable efforts to provide advance notice if we must discontinue this service.

You are responsible for downloading backup copies of your voice recordings if long-term preservation is important to you.

9. Limitation of Liability

To the maximum extent permitted by law, Everyday Love and its officers, directors, employees, and agents shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of data, profits, or business opportunities
Any claims arising from User Content
Service interruptions or technical failures
Actions of third-party service providers

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the specific product or service giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Everyday Love and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your User Content
Your violation of these Terms
Your violation of any rights of another party

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Your use of the Service is at your own risk.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may assert claims in small claims court if your claims qualify.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will cease immediately, but provisions that by their nature should survive (such as ownership, warranty disclaimers, and limitations of liability) will remain in effect.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
